Spousal Family Sponsorship

A Family Visa is simply an exclusive visa that lets a person go to a foreign country and stay there for a limited period with his or her loved ones.  A spousal sponsorship means the husband or wife who stays in Canada sponsors the trip and costs for sustaining lifestyle in Canada for his or her spouse.  It is vital to note that a Spousal Visa or Family Visa doesn’t automatically grant any Permanent Residence. But, if an individual has a close relative in Canada, it is possible to apply for a PR status in the country.  If you are a PR in Canada or already acquired a citizenship, you need to follow the guidelines of the government to apply for a Spousal Visa or Family Visa, filling the required details. You need to ensure that the person who wants to obtain the visa and sponsorship meets all the criteria of the concerned authorities to the last detail, including eligibility requirements for a Temporary Resident (TR) status.

Various categories of Family Visa

There are broad categories of Family Visa and you need to select the most suitable category while applying.

If you have a PR status in Canada, then you are eligible to live with your married wife or husband, processing a Spouse visa for the person and sponsoring his or her stay in the country.

The person who would be sponsored for the visa should be an adult (above 18 years of age). The person should be legally married.

A Common-Law Partner is a person who has lived with an individual for at least 1 year in a conjugal relationship. If you have PR status in Canada and want the Common-Law Partner to live with you, you can apply for the visa.

You need to show proofs that you are in a position to provide the basic needs of your partner during the whole duration of his or her stay. Also, you need to show proofs of having a conjugal relationship with the partner.

If you want to your natural or adopted child to stay with you in Canada, you need to apply for this particular visa.

The child should not be more than 22 years of age. Also, he or she should be unmarried at the time of visa application. There should not be any Common-Law relationship. If the child has any mental / physical disability, the conditions for minimum age can be relaxed.

When you have a PR status in Canada, you can apply for a Family Visa on behalf of your parent / grandparent. Also, an important point in this context is the parent or grandparent can apply for PR status, too, and even work, following relevant guidelines of the Canadian government within a regulatory framework.

  • The PR has to provide proof of their Canadian citizenship.
  • The PR must be at least 18 years of age.
  • The PR has to prove that the sponsored person is my parents or my grandparents.
